Session Contract- READ THE ENTIRETY

1. This agreement constitutes an order for your portraiture services, including the taking of portrait photos as agreed to both parties: SHINEon Boudoir and the contracting party. Unless otherwise specified, it is understood that any and all rights to proofs, final or sample prints, thereof shall remain property of SHINEon and may be used for advertising, display or any other purpose thought proper by SHINEon, if permission is granted.

2. If photographer, Julia Snider, cannot perform this agreement in whole or in part due to a fire, or other casualty, acts of terror or other cause beyond their control SHINEon is not responsible for further liability beyond this agreement. This limitation on liability shall also apply in the event that photographic materials are damaged in processing, lost through camera malfunction, lost in mail, or other wise lost or damaged with fault on the part of photographer. You agree that an entire session cannot be replicated, reenacted or repeated for the purpose of a re-shoot and limits SHINEon's liability to the amount paid under this contract.

3. In the event of an extenuating circumstance on SHINEon's part, SHINEon will reimburse the full amount paid to the customer, including the deposit or will re-schedule for a different time. SHINEon will not be held liable for services not rendered. To receive a refund, SHINEon must have a 4-week notice from the scheduled session.

4. Upon signing of this agreement and payment of the session fee hereto, SHINEon will reserve the time agreed upon and will not make another reservation for the specific time frame.

5. SHINEon is the only photographer to perform the photographic services requested on this contract. No other photographer is allowed to take photos at the session and no other cameras are allowed in the studio.

6. The amount agreed upon covers the photographer’s time, talent, proofing and editing. It also cannot be changed or altered by any means.

7. Full payment of package is due before the session date. This guarantees the time and date allotted for you. Should payment not be received in this time frame, SHINEon reserves the right to offer the date and time to another client.

8. SHINEon’s price list is adjusted periodically and future orders will be charged at current pricing of that time.

9. SHINEon will choose the best images from your session. At no point will SHINEon release raw files to a client.

10. SHINEon will hold a personal previewing and ordering session on the same day of your session. Payment for all printed products are due when ordering, unless a payment plan is in place. Once payment is received, orders are placed. Your final print order will be delivered approximately 6-8 weeks after your previewing session. Due to the very personal nature of photography. ALL PRODUCT SALES ARE FINAL.

11. A client may reschedule an appointment if it is more than 2 weeks prior to the appointment. A $150 RESCHEDULE FEE does apply. The session must be rescheduled no further out than 2 months past the existing appointment date. Only ONE RESCHEDULE is permitted per original booking.

12. Session fees and retainers are non-refundable.

13. If a payment plan is in place and payment has not been completed, 5 days after the due date a $50 late fee will be added to the total.

14. If in the opinion of the photographer, weather or other adverse conditions prevent creation of a portrait meeting the artistic standards of the photographer, SHINEon may elect to use an alternate location or to reschedule the portrait session.

15. Must be 18 years of age to make a purchase or schedule an appointment with SHINEon Boudoir.

16. We reserve the right to refuse service, remove content, or restrict access at our discretion.

17. Your use of this website is also governed by our Privacy Policy, which outlines how we collect, use, and protect your personal information.

IMPORTANT NOTICE REGARDING COPYRIGHT

It is illegal to copy or reproduce these photographs elsewhere without SHINEon Boudoir's permission, and violators of this Federal Law will be subject to its civil and criminal penalties. All photographs, both on SHINEon Boudoir’s website, blog or Facebook page, including all potential proofs and purchased prints, are copyrighted; reproduction of any image by any means, including copying, re-printing, screen captures, and other means of print reproduction are strictly prohibited and are a violation of copyright law. Additionally, it is ILLEGAL to post any of SHINEon Boudoir’s work on the Internet, blogs and social networking sites, without the express permission of the photographer EVEN if it is an image of yourself. The only exception to this is if you have purchased the print released digital files.
